Waivers for minimum instructional hour requirements


At the September Regents meeting, the New York State Board of Regents extended the instructional hour waivers to be available for the 2021-22 school year. Applications for these waivers will be available in the State Aid Management System (SAMS) when the 180 Days Calendar Waiver Form is released. This form will allow districts to apply for a waiver for the 2021-22 school year and the 2020-21 school year.

These waivers are available for districts unable to meet the minimum instructional hour requirement “as a result of an Executive Order(s) for the COVID-19 crisis… or reopening procedures implemented as a result of the COVID-19 crisis.” Executive Order 202 was rescinded June 25, 2021. As of this posting, no Executive Order has been implemented as a result of the COVID-19 crisis in the 2021-22 school year.

Please note that these waivers only apply to the minimum instructional hour requirements specified in Commissioner’s Regulation 175.5. The requirement to hold 180 days of session is a statutory requirement and cannot be covered by this waiver
